Most of you know of Wal-Mart's new (yet quiet) decision to disallow firearm sales to people who's NICS background checks take longer than 3 days. Note I did not say people who are denied by NICS - just those who NICS does not know about (or even when the NICS system is down). Doing this encourages anti-gun forces to create delays in the NICS system and will deny the legal access to firearms to Wal-Mart's customers.

Shortly after this decision became known, I sent a letter to Wal-Mart, Inc complaining and making my unhappiness known.

Below is their (apparently final) response. I don't think I'll be buying any firearms from Wal-Mart again (unless they change their policy). I encourage everyone else to make their firearm and hunting supply purchases elsewere as well.

Wal-Mart's customer relations email address is in the CC: line of this message (as well as pretty much every individual I know who hunts or shoots a gun).

The ......'we will proceed with the sale no matter how long the approval process takes' speaks volumes for them.

They don't care if the feds stall it forever...

I'd say Walmart has gotten too big for it's britches making it's own laws.....

Obviously Walmart doesn't understand that NICS doesn't check conviction records - it only checks arrest records. Know of any courts that have 100% conviction rates on original charges? I don't. That's alot of innocent people.

Hunh? Can anyone confirm this? This would mean that prospective buyers are presumed guilty even AFTER having been proven innocent, in those cases!

Walmart states that only a small fraction of their sales will be impacted because 99% of the sales are approved. They are only partially correct. There sales will also decrease if enough of us stop any purchases from them.

Can you verify this statement? Think about it. If this were true we could get the whole NICS check system thrown out in one rapid heartbeat.

Sorry Mr. Firriolo, but I've been through the system. I have the written proof from the FBI. I don't care what they say on that website. I get delayed EVERY TIME. Why? Because I have a felony arrest on my record. They only check your conviction record after they either delay your purchase or deny it and you appeal.

Yes, Alex, this should be a slam-dunk in court. Class actionable. If dealers knew that some of their lost sales were attribitable to this, there might be more interest. Know any lawyers interested? I can't find any.

I to have been through th system and been denied purely on my arrest record,was later sold what I wanted. So I'd have to say that you are wrong again Mr.firriolo.
